1. Acceptance of Terms
By accessing or using Protevano ("the Service"), operated by Smart Technology Investments LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to modify these terms at any time, and your continued use after changes constitutes acceptance.
2. Description of Service
Protevano provides disability income protection gap analysis tools, including SSDI benefit estimation, employer long-term disability (LTD) gap analysis, state disability program coverage modeling, and income replacement planning. The Service uses publicly available data from the Social Security Administration, Department of Labor, and state insurance departments.
3. Not Insurance or Financial Advice
Protevano is an informational tool and does not constitute insurance advice, financial planning, or a recommendation to purchase any specific insurance product. We are not a licensed insurance agency, broker, or financial advisor. SSDI benefit estimates are projections based on publicly available formulas and may not reflect your actual benefit amount. You should consult a qualified insurance professional or financial planner before making disability coverage decisions.
4. Intellectual Property
All content, algorithms, optimization logic, and data compilations within the Service are the intellectual property of Smart Technology Investments LLC. You may not reverse engineer, decompile, or extract the gap analysis algorithms. Reports generated by the Service are licensed to you for personal use only.
5. Acceptable Use
You agree to use the Service only for lawful purposes related to personal disability income planning. You may not use the Service to generate misleading insurance comparisons, commit insurance fraud, or facilitate any illegal activity. Automated scraping, credential sharing, and circumvention of rate limits are prohibited.
6. API Usage
Developer API access provides Layer 1 data including SSDI benefit tables, state disability program details, and LTD coverage benchmarks. API usage is subject to rate limits defined by your subscription tier. Redistribution of raw API data or use in competing products is prohibited.
7. Limitation of Liability
To the maximum extent permitted by law, Smart Technology Investments LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to incorrect benefit estimates, gaps in coverage analysis, or financial losses from reliance on the Service. Our total liability shall not exceed the fees you paid in the twelve months preceding the claim.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that SSDI formulas, state benefit amounts, or employer LTD benchmarks are current or error-free. Disability insurance regulations and benefit structures change frequently across jurisdictions.
9. Arbitration
Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by JAMS in Los Angeles County, California, under its Streamlined Arbitration Rules. You waive your right to a jury trial and to participate in class action lawsuits. The arbitrator's decision shall be final and binding.
10. Governing Law
These Terms are governed by the laws of the State of California. Any litigation not subject to arbitration shall be brought exclusively in the courts of Los Angeles County, California.
